Waiver of Licensing Requirement – Policy

General Information

The Texas Board of Professional Geoscientists is charged with the responsibility of issuing a license to engage in the public practice of geoscience in the state of Texas only to those individuals who meet the qualifications for licensure, as provided by Texas law.

The Texas Geoscience Practice Act (Texas Occupations Code, Chapter 1002), Section §1002.259 provides that:

“Except for the payment of required fees, the board may waive any of the requirements for licensure by a two-thirds vote of the entire board if the applicant makes a written request and shows good cause and the board determines that the applicant is otherwise qualified for a license.”

TBPG Rule 22 TAC §851.20 (e) addresses the submission of a request for the waiver of a license requirement.

Instructions

An applicant for licensure as a Professional Geoscientist (PG) may request a waiver of a licensing requirement if the applicant meets all the other licensing requirements. Only an applicant for P.G. licensure may request a waiver.

In order for a request for waiver to be considered by the Board at its next meeting, all waiver request and application documentation must be submitted at least three (3) weeks before the Board meeting. Meeting dates can be found under the link TBPG > Board Meetings.

To request a waiver of a licensing requirement, applicants must submit a completed Form VI- Request for Waiver – Policy and Acknowledgement, a completed Application for P.G. Licensure (Form A), all other supporting documentation (such as transcripts, proof of examination scores, etc.), and any examination fee and/or application fees in order for a waiver request to be considered.  All waiver request documents and application materials must be received by TBPG at least three (3) weeks before the next TBPG Board meeting.
